Legal Bases for Processing
If you are in the European Economic Area, the United Kingdom or another place with similar laws, we rely on the following legal bases:
- ContractWhere we need the information to enter into or perform an agreement with you, such as registering your works and paying your royalties.
- Legal obligationWhere the law requires it, such as keeping tax records and collecting tax forms.
- Legitimate interestsWhere we have a legitimate business interest that is not overridden by your rights, such as preventing fraud, securing our systems, evaluating catalogs and defending legal claims.
- ConsentWhere you have given it. You may withdraw consent at any time, without affecting anything we did before you withdrew it.
Providing information needed to register your works and pay you is a requirement of our agreements. If you do not provide it, we may be unable to register those works or release payments to you.
How We Share Your Information
We share personal information only as needed to provide our services and run our business. Mostly, that means the societies, partners and payors involved in registering your works and collecting your royalties, the service providers who help us operate and pay you, and anyone you have authorized to act on your behalf. We may also share it with our affiliates and advisors, with a buyer or successor to our business or catalog, where the law requires it or to protect our rights, or with your consent.
We may use and share aggregated or de-identified information for any lawful purpose, including, but not limited to, product development and research.
International Transfers
We work with rights holders and collect royalties around the world. Your personal information may therefore be transferred to, stored in and processed in the United States, Canada and other countries where we, our partners or our service providers operate. Those countries may have data protection laws that differ from the laws where you live.
Where the law requires it, we rely on appropriate safeguards for these transfers, such as the European Commission's standard contractual clauses.
How Long We Keep It
We keep personal information for as long as we need it for the purposes described in this Policy. In practice, that means for as long as you have an account or an agreement with us, and afterward for as long as we continue to collect or account for royalties earned during that agreement.
We keep financial, royalty and tax records for at least seven years after the last payment or statement they relate to, and longer where needed to resolve disputes, respond to audits or meet legal requirements. When we no longer need information, we delete it or anonymize it.
How We Protect It
We use reasonable administrative, technical and physical safeguards designed to protect personal information, including access controls, encrypted connections and limiting access to people who need it for their work. No system is completely secure, and we cannot guarantee the security of information transmitted to us.
Please keep your Portal credentials confidential and tell us right away if you believe your account has been accessed without your permission. If a security incident affects your personal information, we will notify you and the relevant authorities where the law requires it.
Your Rights and Choices
Depending on where you live, you may have the right to:
- Access the personal information we hold about you and receive a copy of it;
- Correct information that is inaccurate or incomplete;
- Ask us to delete your information, or to restrict how we use it;
- Object to our use of your information based on legitimate interests;
- Receive information you provided to us in a portable format; and
- Withdraw consent you have given us.
To make a request, email info@newtomorrowmg.com. We may need to verify your identity before responding, and we will respond within the time the law requires. Some requests are limited by law. For example, we may need to keep royalty and tax records, and information needed to continue paying you, even if you ask us to delete them.
If you are not satisfied with our response, you may complain to your local data protection authority. In Canada, that is the Office of the Privacy Commissioner of Canada. In the European Economic Area, it is the supervisory authority in the country where you live or work.
